1. Acceptance of Terms

By accessing or using the N1mbus software, website, and related services (collectively, the "Service") provided by N1MBUS SOFTWARE ("N1mbus"), you agree to be bound by these Terms of Service (these "Terms"). If you do not agree to all of the conditions, you may not access or use the Service.

You must be at least 13 years old to use the Service. Users who have not reached the age of majority in their jurisdiction represent and warrant that they have obtained the consent of a parent or legal guardian to agree to these Terms or make a purchase.

2. Description of Service

N1mbus provides client-side modifications and tools for Minecraft. You bear the sole responsibility for ensuring that your use of the Service complies with the rules and policies of any server, platform, or community you participate in.

3. License and Acceptable Use

N1mbus grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly for personal and non-commercial purposes on one hardware device (HWID) per purchased license key.

You shall not: (a) share, distribute, resell, or publicly post any license key, client build, or account credentials; (b) attempt to reverse engineer, decompile, or extract source code from the Service; (c) distribute cracks, mirrors, or modified builds of N1mbus; or (d) use the Service for large-scale commercial streaming or content creation (e.g., monetized channels or audiences over 10,000 subscribers) without prior written consent.

4. Definition of Lifetime Access

For products sold as "Lifetime" access, "Lifetime" is strictly defined as the period during which N1mbus actively maintains, supports, and offers that specific product or service.

N1mbus reserves the right to sunset (discontinue) any product with at least 30 days' notice. Upon sunset, active licenses terminate and no prorated refunds will be issued. However, N1mbus will make reasonable efforts to provide a final offline build or remove DRM restrictions where technically feasible, though this is not guaranteed.

5. User Accounts and Security

You bear the sole responsibility for maintaining the confidentiality of your account credentials and enabling Two-Factor Authentication (2FA) where available. You are fully responsible for all activities that occur under your account.

If your license key or account is compromised due to your negligence, N1mbus reserves the right to temporarily suspend the account to protect our service infrastructure. You may request account recovery, but repeated negligence or intentional sharing will result in a permanent ban.

6. Orders, Payments, and Refund Policy

All sales are final. Because the Service provides immediate access to digital goods, we do not offer refunds, returns, or exchanges once a license key has been generated or delivered, except where required by law.

For EU and UK Customers: By purchasing digital content from N1mbus, you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal once download or access has begun.

Any fraudulent, abusive, or unjustified chargebacks initiated through your payment provider will result in an immediate investigation and potential revocation of your account and licenses.

7. Hardware ID (HWID) and Privacy

To prevent piracy and enforce license limits, the Service collects a unique Hardware ID (HWID) tied to your machine's components. For full details on how we collect, store, and use data, including telemetry and logs, please review our Privacy Policy at https://www.n1mbus.xyz/privacy.

8. Assumption of Risk

You expressly understand that the use of third-party modifications may violate the rules of certain Minecraft servers or platforms. You use the Service entirely at your own risk.

Except in cases of intent or negligence on the part of N1mbus, N1mbus shall not be liable for any in-game bans, account suspensions, blacklisting, or loss of digital assets resulting from your use of the Service. N1mbus does not guarantee the bypass or evasion of any anti-cheat system.

9. Feedback and Submissions

If you submit feedback, ideas, bug reports, or suggestions ("Feedback"), you grant N1mbus a perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable license to use, modify, and incorporate such Feedback without compensation to you. You also waive any moral rights in relation to the Feedback.

10. Termination and Suspension

N1mbus reserves the right to temporarily suspend or permanently terminate your account and licenses without notice or refund for violations of these Terms (including, but not limited to, account sharing, distributing unauthorized builds, harassment of staff, or material breaches).

N1mbus also reserves the right to temporarily suspend an account pending the completion of an investigation into suspected violations.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind. N1mbus expressly disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

Except in cases of intent or gross negligence by N1mbus, to the maximum extent permitted by applicable law, in no event shall N1mbus or its operators be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use.

Except in cases of intent or gross negligence by N1mbus, in no event shall N1mbus's total liability arising out of or related to these Terms exceed the total amount paid by you to N1mbus during the 12 months immediately preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless N1mbus and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) incurred by N1mbus arising out of your intentional or negligent violation of these Terms or your misuse of the Service.

14. Governing Law and Dispute Resolution

These Terms and any disputes arising in connection with them shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.

For any disputes arising out of or in connection with the Service, the Tokyo District Court shall have the exclusive agreed jurisdiction as the court of first instance.

15. Other General Provisions

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement: These Terms, along with the N1mbus Privacy Policy, constitute the entire agreement between you and N1mbus regarding the Service.

Force Majeure: N1mbus shall not be liable for any failure to perform its obligations due to events beyond its reasonable control.

Assignment: N1mbus may assign its rights, obligations, and contractual position under these Terms to a third party as a result of a business transfer, merger, corporate split, or other causes, and you hereby consent to such assignment in advance. You may not assign or transfer your rights, obligations, or contractual position under these Terms to any third party without the prior written consent of N1mbus.

Prevalence of Mandatory Provisions: If any provision of these Terms contradicts mandatory provisions of applicable laws and regulations, such mandatory provisions shall prevail. Even in such cases, the remaining parts of these Terms shall continue to be valid.

16. Modification of Terms

N1mbus may modify these Terms in any of the following cases: (1) When the modification conforms to the general interests of the users. (2) When the modification is not contrary to the purpose of the contract and is reasonable in light of the necessity of the modification, the appropriateness of the modified content, the existence of this provision and its content, and other circumstances pertaining to the modification.

N1mbus will make known the contents of the modified Terms and the effective date thereof by posting an announcement on our official Discord server or website by the effective date. We will provide at least 14 days' notice for material changes.

Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must immediately stop using the Service and may request account deletion.

17. Controlling Language

The English version of these Terms is the original and controlling text. In the event of any conflict, discrepancy, or dispute between the English version and any translated version (including Japanese), the English version shall prevail. However, in relation to users who are consumers residing in Japan, the Japanese version shall prevail. N1mbus will always keep the contents of each language version identical.
